Hmm... Burns 5% avatar has been hatted; non-5% avatar doesn't need a hat, as it already has a crown. Darn. I had a legal loophole argument all lined up, but I read the requirement again, and although it is not explicitly stated that the hatting be current, it could be argued that "must be hatted," rather than "must have been hatted" implies that the avatar in current use must be hatted.
Conclusion: My eligibility for the Order of the Hats depends on, and is approximately concurrent (± time required to swap avatars) with, my attainment, or lack thereof, of the 5% Badge. Regrettably, work and other issues make my return to the top 5% unlikely in the near future.
INB4: Yes, I could have my non-5% avatar hatted, but as I already said, it doesn't need a hat; it has a crown. I could also switch to an avatar more amenable to being hatted, but I like this one.

It used to be worse, though you can still effectively get to how bad it was if you jump out and back in to the editor, especially when using the split keyboard. I'd also recommend only trying to do searches from the top of a topic or top of the topic list.
