Methinks the poster is stretching credibility a bit, to extend to an SJW concept that drunkenness establishes rape. But then, yes, you run into a problem with who raped who: why couldn't "Jake" claim he was the victim? Seems like a push, to me, if they're both drunk, conscious, and neither said, "No."
To me it seems to be much more straightforward if we go by either "who said, 'No,'" or "who was unconscious at the time" (note that "unconscious" includes being zonked by a date rape drug). As @Cursorkeys noted in his example, the guy should have been able to charge rape.

Maybe is just the viewing angle, or the reflections from the polished metal, but the gap between the right blade of the plug and the nail clipper (or whatever that is) shoved over the left blade looks awfully small. Not to mention, of course, the folly of the bare metal conductors exposed to the possibility of being touched.

I am so tempted to say YMBNH (yes, I hear the cries of "...but you have..."), but I know that that is not true and this post is in noway intended to mock or otherwise offend of patronise you. In all seriousness: We are exposed to many "what the fucks" here (am I allowed to say that en clair? What is the PG rating for this Forum anyway?), along with extensive discussion of why we think it is; but little discussion as to why the perpetrator many think (or thought) that it wasn't. So I have a tendency to play "the devil's advocate" with (I hope) a humorist twist on occasion. Besides, we do not learn by just being told what is wrong. No, we learn when we are re-educated with what is right.

The table is in kV; at household voltages, the gap required is going to be rather less than a millimetre and so is easy to achieve even in damp air. In effect, you have to actually touch the conductors together to get a short.

Okay, scratch that. It does seem to have some application in law here in the US; also in the UK, though I didn't dig into the latter. The best reference I found in a hurry was Prosecuting Alcohol Facilitated Sexual Assault (PDF).
I like it much better the way it was put in the code of conduct at Cornell. The relevant clause is:
The responsibility for misinterpretation when either party has been drinking falls on the initiator of further sexual activity.
This seems reasonable, because consent should not belong only to the person who has a vagina. Which is my major objection to the poster, because as it presents the issue, it's pretty evident that Jake is always at fault. Which is idiotic.
