Well, it's either annoy a few able-bodied users who then turn the feature off, or annoy disabled users who then sue you for discrimination. And since MS operate in a country where someone sued McDonalds for making them fat, I wouldn't want to take that risk.

To answer your question, after, because I don't usually think of disabling sticky keys until I activate it accidentally.

But the OS isn't supposed to know what the running program is. How is Windows supposed to know when to just pass "shift is still down" to the program as opposed to toggling sticky keys?
