The main issue here is that the cars - in either the US or Europe - were only required to pass the stationery rolling road test. No-one should be surprised that SHOCKER real world conditions are completely fucking different and pretty much every car fails those levels in real world tests.
I'm not justifying it, and certainly not VW's methods, but that's how it is. Complaining now that emissions are different under different conditions is just

Some of them do (or variants of the same engine) as the most recent US EPA limits were lower than Euro 5 which applied over here until last month.
Except VW, who just cheated everywhere.Probably happens less now that Euro 6 is on par with the EPA limits.
