If there is an accident because of a dysfunction on a non-driverless car, who do you take to court? The carmaker. Same thing for driverless cars.

Ahh, but then they find out you've rooted your car's software, or you've missed your scheduled maintenance, or you tried to run the autopilot in bad weather, or someone put something next to the road that confused the computer or there was a security update and you didn't install it right away etc...
Right now, cars are relatively simple machines. You add software and they become ridiculously complicated. How often does your TV break compared to your computer?

No they aren't. They're already jammed full of (potentially incompatible) software handling "mission critical" stuff like braking, suspension, engine control, accelerators, speed limiting, cruise control, and so on. Not only that, but the software itself is crufty as fuck, developed and tested using practices at best described as "questionable". The real surprise is that there aren't more "runaway vehicle" incidents.

Bonus WTF: Pressing the big red "KILL" button kills the vehicle's occupants.

I drive a 2013 Subaru BRZ. Of all the mission critical electronically managed systems in the thing, the only one without a mechanical linkage is the accelerator. Which you can override with the clutch pedal (or brakes if you own an auto).
So when those systems fail, the driver can still use them, and since the input is the same for both manual and assisted operation are the same controls, failover is seemless.
Take away the controls and you lose the backups.
I endurance race cars as a hobby. In our race series, we're driving older model production cars with fairly unlimited modification. I have a very real understanding of why and how every single part on a car can fail. The electronics go first on the whole.

Yeah I creep out when I think of things like that. Lucky for me I have a few unique skills I can leverage to do damage and/or escape threats:
- I can speak in one language
- I have opposable thumbs
- I'm bipedal
- I can throat sing
- I can create nested if statements...
- I can get nervous and vomit on their shoes.
So you can see that I can dominate if confronted.
The thought po-po might want to think twice before sending their robot monkey's from the future to my crib.

If a human-operated car was involved in the crash, you take them to court - and prove that they were at fault with scads of video and radar evidence showing exactly what they did to cause it. Since there's probably a 99% chance that they did cause it.
If both vehicles were driverless, then the auto manufacturers just quietly pay off the victims, and push out firmware updates if they determine that their software could have handled the situation any better.
I don't really see much difficulty in either situation.

I was listening to the Google people dealing with the emergency evasion software. They said they are tuned to other drivers being dumb (gliding in and out of their lanes), collisions, and deer + other critters that flying in from out of nowhere.
