What about changing the consequences of failed tests from a failure outcome to simply an "unstable build"? That's how we handle that.
Currently 40 broken tests. 1 broken since more than 1 year already.

It depends. Not all CI systems have that state. Jenkins does, but e.g. TeamCity does not.
