I'm hoping not only this case gets thrown out but the judge goes full Judy on the plaintiff's ass.
-
Hmmm...
Late last night Ms Knox posted on Facebook that she assumed her claim would have been against Donegal County Council and an insurance company.
“Never in my life did I think it would be coming from the family,” she wrote.
She said lodged a claim because she had been suffering from post-traumatic stress disorder since the tragedy.

Laura wrote that Stephanie had been informed that a number of other claims were being made in relation to the incident so she sought legal advice.
“Stephanie would never be as spiteful to claim off an 86-year-old man. She was under the impression that the claim was against the Donegal council and due to the same reason that the family were claiming for – algae being on the slipway and other reasons,” she said. It's going to be MacDonald's coffee again.

...the fact that the coffee slipped was her fault, but the fact that, within seven seconds, the coffee caused third degree burns and burned 16% of the skin on her body – that was McDonald’s fault...
Following a calculation of past medical expenses, future expected medical expenses and lost wages, her legal team asked McDonalds for $20,000. Guess what their maximum offer was? $800!

@bb36e Yes, how awful of MacDonald's to heat coffee to the same temperature that an ordinary home kettle heats water to. How could she have possibly predicted that the freakish evil MacDonald's coffee would be exactly the same temperature as any coffee she'd have ever made in her own home.
I've read many defences of the plaintiff in that case, none of which I find persuasive. All of them revolve around the idea that 87 degrees was too hot for coffee. Yet there are legitimate, consumer-benefitting reasons for coffee to be that hot (namely: you can take a short drive to home or work with before it gets cold), and it's no hotter than you'd be used to in your own home. Everyone knows that coffee is hot, and it's reasonable to expect individuals to be able to deal with that without injuring themselves. Will they occasionally fail? Yes, absolutely. (And often they'll be perfectly decent, intelligent people who just made a dumb mistake one time, rather than morons who we should all point at and laugh.) But that's true of loads of consumer products that come with some degree of innate risk; people will sometimes trip and impale themselves on knives, too, but that doesn't mean every time it happens they should be able to sue the shop that sold them the knife on the grounds that it was too sharp.

@cabbage supposedly mcds got hundreds of complaints about the coffee before the incident, which may have added to the prosecution's case
¯_(ツ)_/¯

Have you ever drank coffee straight out of the kettle? It's supposed to be "fast food", not "your coffee might finally be cool enough to sip by the time you get to work". When it's served, it should basically be ready-to-consume; that's literally the whole point of fast food. Your McGriddle or hash brown will be cold by the time your coffee is cool enough to start taking tiny sips from. That is a food service fail.
Plus the cups were hopelessly flimsy and they knew this. They were sturdy enough with the lid on, but customers have to remove the lid in order to add their cream and sugar (which, again, McDonalds knew), and with the lid removed, the cups were simply far too flimsy to safely hold scalding liquids, especially when they're handing them to customers in their vehicles.

More because the claimant is going to end up with a bunch of unnecessary hate mail just because they wanted to cover their costs.
