Toronto lawyers don't know anything about the Internet

From their website Terms:
Links to this Site are not permitted except with the written consent of TO2015™. If you wish to link to the Site, you must submit a written request to TO2015™ to do so. Requests for written consent can be sent to branduse@toronto2015.org . TO2015™ reserves the right to withhold its consent to link, such right to be exercised in its sole and unfettered discretion.
-
So where is the link?
-
They obviously declined his request for a link and he complied
-
I've asked for permission but haven't had a response yet.
Will link (or not) once I get a response.
-
It gets even better:
You agree not to use or attempt to use any engine, software, tool, agent, data or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Site other than the search engine and search agents provided by TO2015™ or generally publicly available browsers.
I found that using Google …

If that's a ban against bots, it does a poor job, since many bots actually use a headless browser to obtain content.
And when exactly are you supposed to agree with these terms? I didn't see any popup or login screen.
-
And robots.txt is empty...
-
They seem to have been shamed into changing it.
Other sites may link to the Site with or without our authorization, and we may block any links to or from the Site. Your use of third party websites and resources is at your own risk.
Given their ignorance, I'm not entirely sure how they plan to block links to the site...
-
referer checking, with redirect to a page "You have reached this website in an illegal manner"?
-
Well, technically you could do that with the referrer.
It's more likely that they don't have a clue, though.

I

the honorable poster to the first three words of the post he replied to..."They seem to" ???
-
Oh bollocks. I meant of the para after the quote.
I need a bigger mobile phone...
-
It actually makes perfect sense.
Why bother thinking about the terms of use, when you can just say you disallow everything and, if shit hits the fan, let the courts choose whether it's enforceable or not?
-
-
Oh bollocks. I meant of the para after the quote.
In order to play, please enter the word from manual: page 7, line 9, word 4?
-
And when exactly are you supposed to agree with these terms?
At least they have that one covered:By using toronto2015.org (including its related subdomains, services and other sites and tools linked to toronto2015.org) (collectively, the "Site"), you agree to these Terms of Use and the general principles for the Site regardless of whether you have read through all of the applicable terms.
Edit: I just noticed that bit’s even better now they’ve been kind enough to allow linking to their site … when using “other sites and tools linked to toronto2015.org” you apparently agree to toronto2015.org’s terms. Google links to it, so I guess virtually everybody in the world therefore agrees to toronto2015.org’s terms of use, regardless of whether they even know it exists.

There seems to be something in the water in Toronto:
-
I don't know what troubles me more - this, or the fact that some people might stake all they have the legal advice of such people whom, following a brief and open-minded assessment of the facts as they are, might not know a great deal about the internet. Or the law. Or both.
(Somewhat edited version of my first draft - we are dealing with lawyers after all...)
-
The search engine provided by TO2015™ appears to be broken. Clicking the search icon expands a text box but nothing's happening when I hit Enter or click the icon again.
Although it looks like they've changed their TOS because it no longer includes that paragraph. Now it says:
Other sites may link to the Site with or without our authorization, and we may block any links to or from the Site. Your use of third party websites and resources is at your own risk.
The use of or embedding of content from this Site is not permitted except with the written consent of TO2015™. Requests for written consent can be sent to brandapprovals@toronto2015.org. TO2015™ reserves the right to withhold such consent, such right to be exercised in its sole and unfettered discretion.
-
How do they want to block linking to the site (banning by referer, and thus they needed non-HTTPS?). Also it is like banning one from calling you by your name.
-

We’ll have to invoke the right to cite material, then, to continue this discussionit is like banning one from calling you by your name.
Hey, it worked for .
