     If you code the solution using a 3rd party library you can only do so if the buyer know he does not have the rights to it, and doesn't plan to sell it etc.... ??

     The work is a "work for hire"; see http://en.wikipedia.org/wiki/Work_for_hire

     This means that the seller sells all copyrights for all the work to the buyer.  You have exclusive and complete copyrights on original code you write and you can transfer those rights in full to the buyer.  You do not have exclusive copyrights on open-source code you use.  You can't legally sell something you don't have.  "Exclusive rights" means that the buyer can deny all access to the work to everybody (even the author, because the author sold his rights).  If there is third-party code, only the third party can sell exclusive rights, and in the case of GNU and GPL code you know they won't.
