It's actually pretty hard, if not impossible, to figure out whether the user is using keyboard + mouse or a touch screen. Unless there's a new JavaScript API for that which I don't know about.
(And you'd most likely have to make stupid buttumptions about how people use convertibles. I switch between touchscreen and track pad all the time, for example, and I won't always physically remove the keyboard before touching the screen.)

One could at least give power users a way to opt out of "touchscreen interface". I'll concede it's probably a sensible default in this day and age. But let the decide they'd rather use a more compact interface.

Then the top would have to be up; if it was open they'd fall out.

Nope, but there is a CSS one, (which means there actually is a JS one that will even call you back if the query changes).

I'm pretty sure browsers will always detect my Surface as a device with an accurate pointing device, which is not how I use it most of the time, so I doubt the API is reliable. Also, according to caniuse.com, Firefox doesn't support it.
